A rideshare collision can affect a passenger, another driver or someone outside the vehicle. Explain your role in the accident in New Jersey and whether you have the trip receipt or app details.

Those details help focus the referral on counsel familiar with rideshare claims. Your attorney can investigate the relevant coverage and accident evidence rather than treating the app booking as the whole case.

How Do You Choose the Right Rideshare Lawyer in New Jersey?

New Jersey regulates rideshare companies by statute, and the numbers in that statute are the starting point of any claim.

Under the New Jersey Transportation Network Company Safety and Regulatory Act (N.J.S.A. 39:5H-1 et seq.), coverage depends on what the driver was doing:

  • App off — the driver's personal auto policy only.
  • App on, awaiting a request — reduced limits, on the order of $50,000 per person / $100,000 per accident for bodily injury plus property damage coverage.
  • Prearranged ride in progress, or passenger on board — at least $1,500,000 in combined single limit liability coverage.

Establishing which period applied is the first task in the case, and it depends on trip records held by the company. A written preservation demand should go out early.

The rest of New Jersey law then applies:

  • PIP pays medical bills first. For an injured passenger this can involve the TNC's required PIP coverage or the passenger's own household policy, and sorting that out affects how treatment is paid for during the case.
  • The limitation on lawsuit (verbal) threshold under N.J.S.A. 39:6A-8 binds people who elected it on their own auto policy, and requires a physician's certification served within 60 days of the answer.
  • Two years to sue (N.J.S.A. 2A:14-2).
  • Modified comparative negligence — no recovery if you are more than 50% at fault (N.J.S.A. 2A:15-5.1).
  • Suit is filed in the Superior Court, Law Division, in the county of the accident or of a party's residence, and most injury matters pass through R. 4:21A arbitration before trial.

What Does a Rideshare Lawyer Cost in New Jersey?

Nothing upfront. New Jersey injury attorneys work on contingency, capped by Rule 1:21-7:

  • 33⅓% of the first $1,000,000 recovered
  • 30% of the next $1,000,000
  • 25% of the next $1,000,000
  • 20% of the next $1,000,000
  • Above $4,000,000, a reasonable fee approved by the court
  • 25% where the client is a minor or an incapacitated person and the matter settles without trial

The fee applies to the net recovery after expenses — reconstruction, medical reports, transcripts, arbitration and filing fees. Ask what those are projected to be and who bears them if the case does not recover. PIP, health insurance, Medicare and Medicaid reimbursement is handled before disbursement.

Our consultation and referral cost nothing at any stage.

Why Choose Michael Brook Attorney Referral for a Rideshare Case in New Jersey?

Because a $1.5 million policy and a $50,000 policy can both be correct answers in the same case depending on a detail recorded only in the company's own system.

  • Free consultation; the referral costs you nothing.
  • Available 24/7 at (800) 669-0060.
  • English, Spanish, and Russian.
  • Over 30 years matching injured people with attorneys across New Jersey and New York.
  • Local case experience across New Jersey counties.
  • Continued involvement after the introduction.

Attorneys in Michael Brook's network raise the same check at every New Jersey rideshare intake: pull the declarations page of the client's own auto policy and confirm the tort option before valuing anything. Whether the verbal threshold applies changes the case entirely.
